1. Acceptance of Terms
By accessing or using any product or service provided by Ashulabs ("we", "us", "our") through ashulabs.com or any of our applications, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our services.
We have written these terms in plain English because we believe you should be able to understand the agreement you are entering into. If anything is unclear, feel free to reach out to us.
2. Our Services
Ashulabs builds software products for businesses across several industries:
- Healthcare Management System (HMS) — A complete hospital and clinic management platform covering patient records, appointments, billing, pharmacy, and more.
- School ERP (MSLS) — A school management system for admissions, attendance, grades, fee collection, timetabling, and parent communication.
- Retail POS — A point-of-sale and inventory management system for retail businesses.
- Website Design — Custom website design and development services for businesses of all sizes.
We may add, modify, or discontinue features or products over time. We will do our best to communicate significant changes in advance.
3. Accounts
When you create an account with us, you are responsible for keeping your login credentials secure. Please use a strong password and do not share your account with others.
- You must be at least 18 years old to create an account, or you must be authorized by your institution (school, hospital, business) to use the service on their behalf.
- You are responsible for all activity that occurs under your account.
- If you suspect unauthorized access to your account, please contact us immediately at support@ashulabs.com.
- We reserve the right to suspend or terminate accounts that violate these terms.
4. Free and Paid Plans
Free Tier:
- We offer a free tier for our products so you can try them out and see if they work for you.
- The free tier is provided as-is, without any service level guarantees. We do our best to keep it running well, but it may have limitations on features, storage, or support.
- We may modify or discontinue the free tier at any time, with reasonable notice where possible.
Paid Plans:
- Paid plans unlock advanced features, higher limits, and priority support.
- Paid plans include a service level agreement (SLA) as described in the plan details at the time of purchase.
- If you are not satisfied with a paid plan, you can request a full refund within 15 days of purchase. After 15 days, refunds are handled on a case-by-case basis.
- Billing is based on the plan you choose. We will always be transparent about pricing before you are charged.
5. Acceptable Use
We trust our users, but we do ask that you use our services responsibly. You agree not to:
- Use our services for any illegal or unauthorized purpose.
- Attempt to reverse engineer, decompile, or disassemble any part of our software.
- Interfere with or disrupt the integrity or performance of our services.
- Upload or transmit viruses, malware, or any other harmful code.
- Access or attempt to access other users' accounts or data without authorization.
- Use our services to store or transmit content that is unlawful, defamatory, or infringes on the rights of others.
- Resell, sublicense, or redistribute our software without written permission from us.
If we find that you are misusing our services, we may suspend or terminate your access. We will try to reach out and resolve the issue before taking such action, unless the situation is urgent.
6. Data Ownership
This is simple: your data is your data. We do not claim ownership of any data you enter into our systems.
- Healthcare data belongs to the healthcare facility. Patient records, prescriptions, lab results — all of it is yours.
- School data belongs to the school. Student records, grades, attendance, fee records — all yours.
- Retail data belongs to the business. Sales records, inventory data, customer information — yours.
- Any content you create, upload, or store using our services remains your property.
We only access your data when necessary to provide the service, troubleshoot issues at your request, or comply with legal obligations. We will never sell your data to third parties. For more details on how we handle your information, please see our Privacy Policy.
7. Service Availability
We work hard to keep our services running smoothly and aim for high uptime. That said, no software service can guarantee 100% availability. Here is what you can expect:
- We aim for at least 99.9% uptime for paid plans.
- Scheduled maintenance windows will be communicated in advance, typically at least 48 hours ahead of time, and we will try to schedule them during off-peak hours.
- In the event of unplanned downtime, we will work to restore service as quickly as possible and keep you informed.
- The free tier may experience occasional downtime for maintenance or updates without advance notice.
8. Intellectual Property
The Ashulabs brand, logo, website design, and all software code are the intellectual property of Ashulabs. You may not copy, modify, or distribute our brand assets or code without our written permission.
Conversely, your data, content, and any materials you provide remain your intellectual property. Using our services does not grant us any ownership rights over your content.
9. Limitation of Liability
We stand behind our products and do our best to deliver reliable, high-quality software. However, to the extent permitted by applicable law:
- Ashulabs is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.
- Our total liability for any claim arising from these terms or your use of our services is limited to the amount you have paid to Ashulabs in the 12 months preceding the claim.
- If you are on the free tier and have not paid anything, our liability is limited to making reasonable efforts to resolve the issue.
This does not limit any rights you may have under consumer protection laws that cannot be waived by contract.
10. Termination
Either you or Ashulabs can end this agreement:
- You can stop using our services and close your account at any time by contacting us.
- We may terminate or suspend your account if you violate these terms. For non-urgent situations, we will give you 30 days' notice and an opportunity to resolve the issue.
- If we decide to discontinue a product entirely, we will give at least 30 days' notice so you can make arrangements.
- Before your account is closed, you will have the opportunity to export your data. We will provide reasonable assistance to help you retrieve your information.
- After account closure, we will retain your data for 30 days in case you change your mind, and then permanently delete it unless we are required by law to keep it longer.
11. Governing Law
These terms are governed by the laws of India. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts in Bengaluru, India.
We encourage you to reach out to us directly before pursuing any legal action. Most issues can be resolved through a simple conversation.
12. Changes to These Terms
We may update these terms from time to time. When we make changes:
- For material changes, we will provide at least 30 days' notice via email or a prominent notice on our website before the changes take effect.
- Minor changes (such as fixing typos or clarifying language without changing meaning) may be made without notice.
- Your continued use of our services after the changes take effect means you accept the updated terms.
- If you disagree with the changes, you may close your account and export your data before the new terms take effect.
